Terms of Service

MAAGEMSHOUSE (“we”, “us”) is an online retailer of natural gemstones and jewellery operating from Kolkata, West Bengal, India. These terms govern your use of this website and any order you place through it. By placing an order you confirm that you have read and accept these terms, our Privacy Policy, Shipping & Delivery Policy, and Returns, Refunds & Cancellations Policy.

If you do not agree with these terms, please do not place an order. Where a specific product page or a written message from us conflicts with these terms, that more specific commitment applies for that order only.

You must be at least 18 years old and able to form a binding contract to buy from us. Keep your sign-in credentials confidential and tell us promptly if you believe your account has been used without your permission. You are responsible for activity that happens under your account, and you must provide accurate information when you register and when you place an order.

We may refuse or cancel an order if your details are incomplete or inaccurate, if payment fails, if the item is out of stock, or if we cannot deliver to your address, and we will refund any amount already taken.

We work to present each stone accurately, with its type, variety, origin, treatment, weight, dimensions, and cut as recorded on the product page. Because natural gemstones are unique, exact weight and dimension can vary slightly by a small margin within the stated measurements, and photographs represent the actual piece you will receive rather than a stock image. If a piece you received differs materially from its description, tell us and we will make it right under our returns policy.

Prices are shown in Indian Rupees. The total confirmed by our server at checkout is the amount you pay; totals in your browser are estimates until the server confirms them. We may correct a pricing error before dispatch, and will refund any overcharge.

Placing an order is an offer to buy. Our order confirmation acknowledges that we have received your order, but a contract forms only when we dispatch the piece. We may decline an order and refund you in full, for example if an item turns out to be unavailable, if a price or description was materially wrong, or if we cannot verify payment.

Each order is tracked through the stages Confirmed, Packed, Shipped, Out for delivery, and Delivered, and you can follow it from your account. Orders may also move to Cancelled or Returned.

We accept the methods shown at checkout:

• Cash on delivery — pay the delivery partner when the parcel arrives. Please keep the exact amount ready; an unavailable courier may delay delivery.
• UPI — pay to the UPI ID shown at checkout, or scan the QR code we provide.
• Bank transfer — pay using the account details shown at checkout.

For UPI and bank transfers, we treat the order as paid once the payment provider confirms the transaction. We do not accept card or UPI credentials, and we will never ask you to send them by email, message, or phone. Anyone who asks you for them is not us: report it to [email protected].

Delivery timelines, charges, tracking, and what to do if a parcel is late or arrives damaged are set out in our Shipping & Delivery Policy. Please give a complete and reachable address, and check it before you place the order, because a wrong address can delay or prevent delivery.

You may request a return, refund, or cancellation in line with our Returns, Refunds & Cancellations Policy. That policy forms part of these terms, sets the return window, lists the limited categories we cannot accept back, and explains how and when money is refunded.

We stand behind the origin, treatment, and certification stated on each product page. If you believe a stone you received is not as described, contact us within the return window with your order number and photographs, and we will arrange an independent assessment at our cost where the dispute requires one. If a piece is confirmed to differ materially from its description, we will refund or replace it, and cover return shipping.

Your statutory rights as a consumer under Indian consumer law are not limited by anything in these terms.

The MAAGEMSHOUSE name, logo, site design, photography, text, and product listings belong to us or our licensors. You may not copy, adapt, resell, or commercially reuse them without written permission. Product images and descriptions may be shared privately and linked to, but not republished commercially.

You agree not to:

• use the site unlawfully, or in a way that harms us, our customers, or the site;
• attempt to gain unauthorised access to the site, another customer's account, or our systems;
• interfere with the site’s operation, including by scraping it at a rate that degrades the service;
• submit reviews or other content that is false, misleading, defamatory, or unlawful;
• resell or re-export our products where doing so breaches our terms with a supplier or applicable law.

We take reasonable care in presenting our products and in processing your order, but the site is provided “as is”. To the extent permitted by law, we do not warrant that the site will be uninterrupted or error-free, or that a particular stone will remain available.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Subject to that, we are not liable for indirect or consequential loss, and our total liability arising from an order is limited to the amount you paid for that order.

You agree to indemnify us against claims, damages, and reasonable costs arising from your misuse of the site, your breach of these terms, or your unlawful or defamatory content.

These terms are governed by the laws of India. The courts at Kolkata, West Bengal have exclusive jurisdiction, and both you and we are subject to them. If any provision is found unenforceable, the rest of these terms still apply. Nothing here limits your right to approach a consumer forum or the National Consumer Helpline.

We may update these terms, and the “last updated” date at the top will change. The terms in force at the time you place an order are the ones that apply to that order.
